VISITOR DECLARATIONS:
I, the undersigned, hereby declare, accept, and acknowledge the following:
- That I must act prudently within the Park facilities and comply at all times with the rules, warnings, and safety measures applicable to the activities and attractions.
- That, due to the nature of the water and adventure activities conducted at the Park, participation in the attractions involves inherent risks, both for me and for any minor(s) under my care, including, without limitation, slips, falls, impacts, scrapes, bruises, injuries, natural or uneven surfaces, changes in terrain elevation, stairs, natural elements, weather conditions, physical exertion, fatigue, dehydration, and interactions with other participants. EL DORADO PARK shall maintain trained personnel and first-aid resources available on its premises to provide initial assistance in the event of accidents or emergencies occurring within the Park.
- Accordingly, I declare, accept, and acknowledge that the occurrence of damages or incidents arising from the inherent risks associated with the water and adventure activities carried out at the Park shall not, in and of itself, constitute liability attributable to El Dorado Park (Centurium Bay Company, S.A.S.), its officers, employees, affiliated companies, agents, contractors, subcontractors, business partners, and other individuals or legal entities involved in the operation and commercialization of the Park (the “Released Parties”), provided that such damages or incidents are not the result of any breach, fault, negligence, or omission attributable to the Released Parties.
- That neither I nor any minor(s) under my care suffer from any physical, mental, or health condition, illness, or symptom that would make participation in the Park’s activities inadvisable, increase the inherent risks of our participation, place other participants or Park personnel at risk, or adversely affect the proper conduct of the activities carried out therein. I undertake to immediately report any symptoms of fatigue, dehydration, discomfort, or any other symptom to El Dorado Park and its personnel during our visit.
- That, for our own safety and physical well-being, El Dorado Park personnel have the authority to prevent us from continuing or participating in any activity whenever they reasonably determine that my health and safety (or that of any minor(s) under my care), or that of other visitors or Park personnel, may be compromised. In such cases, Park personnel shall inform the customer of the reasons for such decision.
- That neither I nor any minor(s) under my care should exceed our respective individual abilities; that we must participate only in activities for which we are physically and mentally fit; and that we must act at all times with prudence, care, and moderation.
- That I must respect, pay attention to, comply with, follow, and observe all rules, instructions, information, warnings, signs, recommendations, restrictions, and safety measures communicated by the Park or its personnel through any means whatsoever, including messages, audio recordings, images, videos, voice announcements, screens, signs, posters, notices, or any other method. As a visitor and parent, guardian, representative, or custodian of any minor(s) under my care, it is my responsibility to pay attention to all information communicated, displayed, or otherwise made available by the Park.
- That both I and any minor(s) under my care know how to swim, or, if we do not know how to swim, we will wear life jackets when entering the water.
- That any claim, action, or proceeding relating to our participation in the Park’s activities, as well as all matters relating to this document, shall be governed by, submitted to, and interpreted exclusively in accordance with the laws of the Dominican Republic and before the courts or public institutions of the Dominican Republic.
Where applicable, I acknowledge that I am responsible for supervising any minor(s) under my care during their stay at the Park. I further declare that I possess parental authority, custody, guardianship, or any other legal right or duty of care with respect to such minors and therefore have full legal capacity to grant this authorization. Through this document, I authorize the participation of such minors in the Park’s activities and consent to the application to them of the rules and safety measures established herein, as well as the terms and conditions and liability waivers contained in this document.
